TERMS & CONDITIONS
APPLICABILITY
1.1 These general terms and conditions apply to all offers from, orders from and agreements with
Tanni’s Fashion to the exclusion of any other general terms and conditions. A written copy of
these conditions will be sent on request.
1.2 Accepting an offer or placing an order means that the customer accepts the applicability of these
conditions.
1.3 It is only possible to deviate from the provisions in these conditions if and insofar as this has been
accepted in writing by Tanni’s Fashion, in which case the other provisions will remain in full force.
1.4 Tanni’s Fashion is authorized to use third parties for the execution of the order (s). All rights and
claims, as stipulated in these general terms and conditions and in any further agreements for and
for the benefit of Tanni’s Fashion, are also stipulated for and on behalf of intermediaries and
other third parties engaged by Tanni’s Fashion in the context of the agreement, as well as for
anyone from whom Tanni’s Fashion purchases products, services and / or parts.
ARTICLE 2. OFFERS / AGREEMENTS
2.1 All offers from Tanni’s Fashion are without obligation and Tanni’s Fashion expressly reserves the
right to withdraw offers. All offers are subject to availability. Price changes are reserved at all
times, especially when this is necessary on the basis of (legal) regulations. See also article 3.8.
2.2 An agreement is only concluded after acceptance of the order by Tanni’s Fashion. Tanni’s Fashion
is entitled to refuse orders or to attach certain conditions to the delivery.
ARTICLE 3. PRICES AND PAYMENTS
3.1 The prices stated with the products are in euros, including VAT. Any shipping and / or payment
charges and any taxes or other charges will be listed separately.
3.2 Payment must be made without discount or compensation within 7 days of the invoice date.
3.3 Payment can be made in (one of) the way (s) as indicated during the ordering process. Further
(payment-order) conditions can be imposed on an order. When paying by bank, the date of
payment is the date of crediting the bank account of Tanni’s Fashion.
3.4 The customer gives Tanni’s Fashion permission to perform all actions necessary for payment to be made in the
payment method chosen by the customer.
3.5 If the payment term is exceeded, Tanni’s Fashion is entitled to cancel the order and dissolve the
purchase from the due date of the invoice.
ARTICLE 4. DELIVERY
4.1 The delivery times stated by Tanni’s Fashion are only indicative and cannot be regarded as a
deadline. Tanni’s Fashion is never liable for any damage resulting from exceeding delivery times.
4.2 Tanni’s Fashion will strive to adhere to the specified delivery times as accurately as possible,
based on the principle that the ordered goods, if in stock, will be delivered within 3 working
days after the payment date.
4.3 Tanni’s Fashion uses a delivery period of 15 days, (only valid for worldwide shipping) counting
from the day on which the customer placed the order with Tanni’s Fashion.
4.4 If the order is longer due to unforeseen circumstances due to customs declaration for worldwide
shipping, Tanni’s Fashion is not liable for exceeding the aforementioned delivery period.
4.5 The delivery of the products takes place at the place and time when the products are ready for
shipment to the customer.
ARTICLE 5. TRANSFER OF RISK AND OWNERSHIP
5.1 The ownership of the delivered products will only transfer if the customer has paid all that is
owed to Tanni”s Fashion on the basis of any agreement. The risk with regard to the products
is already transferred to the customer at the time of delivery.
5.2 The customer is obliged to store the products delivered under retention of title with due care.
5.3 Tanni’s Fashion is entitled, if the customer fails to fulfill his obligations, to immediately take back
the products delivered under retention of title, still present at the customer without prior notice
of default. Insofar as necessary, the customer irrevocably authorizes Tanni’s Fashion to exercise
this right of return.
5.4 In case and insofar as Tanni’s Fashion has made use of its right to take back as referred to in
Article 5.3, the agreement will be dissolved in whole or in part without judicial intervention,
without prejudice to Tanni’s Fashion’s right to compensation for damage and costs. In that case
the customer will be credited for the purchase price less the damage suffered by Tanni’s Fashion
(including depreciation) and costs incurred.
5.5 The customer is obliged, if requested, to inform Tanni’s Fashion where the products are located
and to whom they may have been sold.
ARTICLE 6. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
6.1 All product and brand names, logo and images used by Tanni’s Fashion are the property of
their respective owners. Photos taken by Tanni’s Fashion may not be used without permission,
and or reproduced by third parties, regardless of whether they have been made available to
customers. Intellectual property rights and copyrights apply to this.
6.2 The customer must fully and unconditionally respect all intellectual and industrial property rights
that rest on the products delivered by Tanni’s Fashion.
6.3 Tanni’s Fashion is, subject to intent or gross negligence, never liable for direct or indirect damage,
which is the result of violation of any (unwritten) right of intellectual and / or industrial property,
licenses or other rights of third parties.
ARTICLE 7. DISSOLUTION
7.1 During 14 working days after receipt of the ordered product, the customer has the right to
terminate the agreement without giving any reason and to return the product to Tanni’s Fashion
at his expense and risk. Returns are only accepted in this case for serious reasons.
7.2 In case of dissolution in accordance with article 7.1, the customer will be credited for the
purchase price minus the (possible) shipping costs. Payments already made will be refunded to
the customer by Tanni’s Fashion within 14 days after receipt of the return shipment, but without
payment of interest.
ARTICLE 8. COMPLAINTS AND WARRANTY
8.1 The customer has the obligation to check on delivery whether the products meet the agreement.
If this is not the case, the customer must inform Tanni’s Fashion as soon as possible, but in any
case within 7 working days after delivery, or after observation was reasonably possible, in writing
and with reasons. Failing this, any claim in this regard lapses.
8.2 Any claim by the customer with regard to delivered products will also lapse if: a. The products can
no longer be identified as being from Tanni’s Fashion; b. the defects are (partly) the result of
normal wear and tear, injudicious and / or incorrect treatment, use and / or storage or
maintenance of the products; c. the customer has not, not timely or not properly complied with
the fulfillment of any obligation resting on him.
8.3 If it has been demonstrated that the products do not comply with the agreement, Tanni’s Fashion
has the choice of either refund the relevant products against return thereof, the invoice value
thereof. These general terms and conditions are fully applicable to redelivery.
ARTICLE 9. ORDERS / COMMUNICATION
9.1 For misunderstandings, mutilations, delays or improper transmission of orders and
communications as a result of the use of the Internet or any other means of communication in
the traffic between the customer and Tanni’s Fashion, or between Tanni’s Fashion and third
parties, insofar as these relate to the Tanni’s Fashion is not liable for the relationship between the
customer and Tanni’s Fashion, unless and insofar as there is intent or gross negligence on the part
of Tanni’s Fashion.
ARTICLE 10. FORCE MAJEURE
10.1 Without prejudice to the other rights to which it is entitled, Tanni’s Fashion has the right, in the
event of force majeure, to suspend the execution of an order, or to dissolve the agreement in
whole or in part, without judicial intervention, at its own discretion, due to this to inform the
customer in writing and this without Tanni’s Fashion being obliged to pay any compensation,
unless this would be unacceptable in the circumstances according to standards of reasonableness
and fairness.
10.2 Force majeure means any shortcoming that cannot be attributed to Tanni’s Fashion, because it
is not due to its fault and is not for its account under the law, legal act or prevailing views.
ARTICLE 11. PERSONAL DATA
11.1 Personal data entered by the customer will be included in the customer file of Tanni’s Fashion.
The data will only be used for the execution of the customer’s order.
ARTICLE 12. MISCELLANEOUS
12.1 If the customer provides Tanni’s Fashion with an address, Tanni’s Fashion is entitled to send all
orders to that address, unless the customer gives Tanni’s Fashion a different address to which
the orders must be sent.
12.2 If Tanni’s Fashion permits deviations from these general terms and conditions, tacitly or
otherwise, for a short or longer period of time, this does not affect its right to demand
immediate and strict compliance with these general terms and conditions. The customer can
never assert any right on the grounds that Tanni’s Fashion applies these conditions smoothly.
12.3 If one or more of the provisions of these conditions or any other agreement with Tanni’s
Fashion conflict with any applicable legal provision, the relevant provision will lapse and will be
replaced by a new legally permissible one to be determined by Tanni’s Fashion. comparable
provision.
ARTICLE 13. APPLICABLE LAW AND COMPETENT COURT
13.1 All rights, obligations, offers, orders and agreements to which these conditions apply, as well as
these conditions, are exclusively governed by Dutch law.
3.2 All disputes between parties will be submitted exclusively to the competent court in the Netherlands.
ARTICLE 14. RIGHT OF WITHDRAWAL
14.1 You have the right to cancel your order up to 14 days after receipt without giving any reason.
After cancellation you have another 14 days to return your product. You will then be credited
the full order amount including shipping. Only the costs for returning from your home to Tanni’s
Fashion are for your own account. These costs are approximately 6.95 per package, for the exact
rates consult the website of your carrier. If you make use of your right of withdrawal, the
product will be returned to Tanni”s Fashion with all accessories and – if reasonably possible – in
the original condition and packaging. To exercise this right, please contact us via
info@tannisfashion.com. We will then refund the order amount due within 14 days after
registration of your return, provided that the product has already been returned in good order.
